A former Yazoo City police officer and his wife pleaded guilty to exploitation of a vulnerable person after the attorney general’s office proved that about $89,000 was owed in restitution.
James and Cynthia Jackson pleaded guilty and were sentenced to five suspended years and placed on five years of supervised probation.
Based on the indictment provided by the attorney general’s office, the couple illegally used the funds of an elderly woman housed in a care facility between May 2015 and September 2015.
“...with knowledge that (the victim) was at that time a patient in a care facility, did exploit (the victim) by the illegal and improper use of (her) resources to their own profit or advantage, with or without consent..” the indictment said.
The Yazoo Herald does not identify victims of crime.
The indictment said the Jacksons made withdrawals and tranfers from the victim’s banking account into their own. They also wrote checks on a bank account that belonged to the victim.
The attorney general’s office argued that the victim was owed a total of $293,614 in restitution from the Jacksons, providing various testimony and documents that supposedly showed the amount of money taken by the Jacksons.
“This court finds that the state was only able to prove that $88,940 is owed in restitution to (the victim),” the order said. “It is therefore ordered and adjudged that James and Cynthia Jackson are required to pay $88,940.77 in restitution…this amount is to be paid at a rate of $1,500 a month, and the total amount must be paid within the Jacksons’ five-year supervised probationary period.”
The order also said if the Jacksons become 90 days delinquent, they will automatically be transferred to the Restitution Center to pay the balance owed to the victim.
