Ellett that a Motion to Substitute Guardian and Close Guardianship has been filed in the Chancery Court of Yazoo County, Mississippi.  The Motion to Substitute Guardian and to Close Guardianship was filed on July 25, 2012, in the Chancery Court of Yazoo County, Mississippi, by T. Mark Sledge, attorney of record for the Guardianship, and states as follows:
1. That the above Guardianship was opened on September 30, 1997.
2. That there has been no activity in the Guardianship since the time that it was opened.
3. That following diligent search and inquiry, neither the Guardian, Tamela R. Ellett, or the Ward, Johnny Dwayne Jones, Jr., can be located at this time.
4. That the Guardian, Tamela R. Ellett, and the Ward, Johnny Dwayne Jones, Jr., are non­residents of the State of Mississippi, or not to be found therein upon diligent search and inquiry, and the post office and street address of Tamela R. Ellett and Johnny Dwayne Jones, Jr. are unknown after diligent search and inquiry.
5. That T. Mark Sledge would request that Quint Carver, the Chancery Clerk of Yazoo County, be named as Guardian in above styled and numbered cause.
VI. That upon Quint Carver being named Guardian, attorney for the Guardianship, would request that he be allowed to close the Guardianship and finally conclude this matter.
Tamela R. Ellett is hereby cited to appear and answer the Motion in the Chancery Court of Yazoo County, Mississippi, before the Honorable Janace Harvey-Goree on October 11, 2012, at 9:30 a.m. at the Yazoo County Courthouse in Yazoo City, Mississippi.  You are required to mail or hand deliver a copy of a written response to the Motion to T. ORDINANCE  OF THE CITY OF YAZOO CITY, MISSISSIPPI
ESTABLISHING LICENSE
REQUIREMENTS FOR
ELECTRICIANS, PLUMBERS, HVAC, GAS FITTERS AND
CONTRACTORS; AND FOR
RELATED PURPOSES

WHEREAS, the governing authorities for the City of Yazoo Mississippi find that it is necessar y to protect the health, safety, and general welfare of all persons dealing with those who are engaged in the vocation of contracting, plumbing, gas fitting, heating and ventilation (HVAC), and electrical wiring; and
WHEREAS,  the governing authorities for the City of Yazoo Mississippi also find that it is necessary to afford persons dealing with those engaged in the vocations of contracting, plumbing, HVAC, and electrical wiring practical protection against incompetent, inexperienced, and unlawful and fraudulent acts of those participating in the aforementioned various trades; and
WHEREAS, the governing authorities for the City of Yazoo Mississippi believe that the best interest of the public would be served by adopting ordinances requiring the licensing of those engaged in the vocations and trades cited;
NOW THEREFORE BE IT ORDAINED by the Board of Mayor and Aldermen of Yazoo City, Mississippi in council convened that the following ordinances be adopted:
Section 1  Definitions
(a) Contracting means the erection, building, construction, reconstruction, repair, maintenance or related work on any project whether public or private save for work performed by an owner erecting, building, constructing, reconstructing, repairing, or maintaining a structure for which a sale, transfer, or lease will not occur prior to occupancy and completion by the owner.
(b) Electrical wiring means the construction, repair, maintenance, or work related to power, lighting, signs, appliances, fixtures, and other equipment which requires electricity for operation.
(c)Gas fitting means the installing, repairing, and construction of pipes and related equipment for the distribution of gas.
(d)Heating Ventilation and Air Conditioning (HVAC) means the technology related to providing environmental indoor comfort through the generation and transfer of energy and the exchange and circulation of air.
(e)Person means an individual, firm, corporation, joint venture, partnership, association, or other business entity.
(f)Plumbing means the installing, repairing, and construction of pipes and drains in a building for the distribution of potable drinking water and removal of waterborne wastes and the skilled trade of working with pipes, tubing, and fixtures in such systems.
Section 2. General Provisions.
(a)It shall be unlawful for any person to engage in the vocations or trades of contracting, electrical wiring, heating ventilation and air conditioning (HVAC), gas fitting and plumbing without first having obtained a license from the Mississippi State Board of Contractors, a municipality of the State of Mississippi, or another state in which the Mississippi State Board of Contractors has determined that reciprocity applies.
(b)All persons engaged in the vocations of contracting, electrical wiring, HVAC, gas fitting and plumbing shall be required to register with the building official for the City of Yazoo, Mississippi by submitting a copy of their current license issued by the Mississippi State Board of Contractors, another  Mississippi municipality, or another state in which reciprocity applies and paying the sum of $25.00.  If the person is licensed by another state,  then in addition to a copy of his current license, he/she must submit a certified letter from the Mississippi State Board of Contractors confirming that he/she is eligible for reciprocity.   
The building official for the City of Yazoo shall issue a registration card containing the name, license number, and issuing authority to the person which shall be valid for a period of one (1) year.  The registration card must be renewed annually by the submission of proof that the person’s license has been renewed by the issuing authority.  The annual registration renewal fee shall be $25.00.
(c)An application for a permit shall be accompanied by a copy of the prime contractor, sub-contractor, or sub-subcontractor’s current license and registration card issued by the building official for the City of Yazoo.  If the license is issued in another state, then a copy of a letter from the Mississippi State Board of Contractors confirming the grant of reciprocity shall also be attached to the permit application with the license and registration card.  No permit shall be issued for the performance of work if  the application does not have attached a copy of the person’s current license, registration card, and if applicable, letter granting reciprocity.
(d)The provisions of this ordinance apply to prime contractors, sub-contractors and sub-subcontractors.   
Section 3. Liability Insurance and Bonding
Any person engaged in the vocations of contracting, electrical wiring, HVAC, plumbing, and gas fitting shall attach to each application for a permit proof that he/she has obtained a bond from a surety qualified to do business in the State of Mississippi for faithful performance of the work being performed that is the equivalent of one hundred percent (100%) of the contract amount to be paid for the work.  In addition, the person must also attach to the application proof that he/she has obtained liability insurance with coverage limits of $100,000 for personal injury to any one person $500,000 per occurrence for personal injury and $100,000.00 for damage to property.
Section 4. Enforcement
The building official and law enforcement officers for the City of Yazoo shall have authority to investigate violations of this chapter and may swear out an affidavit against violators which shall be heard in the City of Yazoo City municipal court or other courts of competent jurisdiction.
Section 5. Penalties for Violation
Any person found guilty of violation the provisions of this ordinance shall be fined a penalty of at least $250.00 and not greater than $500.00 for each separate offense committed.   
Section 6. Effective Date
The provisions of this ordinance shall become effective thirty (30) days from and after passage.

The Board of Supervisors, acting for and on behalf of Yazoo County, Mississippi (the “County”), took up for consideration the matter of issuing general obligation bonds of the County in the principal amount not to exceed Two Million Five Hundred Thousand Dollars ($2,500,000) for the purpose of providing funds to pay for the cost of (i) constructing, reconstructing, and repairing roads, highways and bridges, and acquiring the necessary land, including land for road building materials, acquiring rights-of-way therefor; and the purchase of heavy construction equipment and accessories thereto reasonably required to construct, repair and renovate roads, highways and bridges and approaches thereto within the County; (ii) paying the costs of issuing the bonds; and (iii) other related improvements within the County.
Thereupon, Supervisor Willie Wright offered and moved the adoption of the following resolution (the “Resolution”):
RESOLUTION DECLARING THE INTENTION OF THE BOARD OF SUPERVISORS OF YAZOO COUNTY, MISSISSIPPI TO ISSUE GENERAL OBLIGATION BONDS FOR THE PURPOSE OF PROVIDING FUNDS TO PAY FOR THE COST OF (I) CONSTRUCTING, RECONSTRUCTING, AND REPAIRING ROADS, HIGHWAYS AND BRIDGES, AND ACQUIRING THE NECESSARY LAND, INCLUDING LAND FOR ROAD BUILDING MATERIALS, ACQUIRING RIGHTS-OF-WAY THEREFOR; AND THE PURCHASE OF HEAVY CONSTRUCTION EQUIPMENT AND ACCESSORIES THERETO REASONABLY REQUIRED TO CONSTRUCT, REPAIR AND RENOVATE ROADS, HIGHWAYS AND BRIDGES AND APPROACHES THERETO WITHIN THE COUNTY; (II) PAYING THE COSTS OF ISSUING THE BONDS; AND (III) OTHER RELATED IMPROVEMENTS WITHIN THE COUNTY.
WHEREAS, the Board of Supervisors of Yazoo County, Mississippi (the “Governing Body” of the “County”), does hereby find, determine, adjudicate, and declare as follows:
1. The County is authorized by Sections 19-9-1 et seq., Mississippi Code of 1972, as amended (the “Code”), to issue general obligation bonds for the purpose of providing funds to pay for the cost of (i) constructing, reconstructing, and repairing roads, highways and bridges, and acquiring the necessary land, including land for road building materials, acquiring rights-of-way therefor; and the purchase of heavy construction equipment and accessories thereto reasonably required to construct, repair and renovate roads, highways and bridges and approaches thereto within the County; (ii) paying the costs of issuing the bonds; and (iii) other related improvements within the County (the “Project”).
2. It is now necessary and in the public interest for the County to issue general obligation bonds in a principal amount not to exceed Two Million Five Hundred Thousand Dollars ($2,500,000) (the “Bonds”) to provide funds to pay for the cost of the Project.
3. The assessed valuation of all taxable property within the County as of March, 2012, according to the last completed assessment for taxation, is the sum of One Hundred Fifty-four Million Two Hundred Sixty-seven Thousand Seven Hundred Ninety-nine Dollars ($154,267,799).  The total amount of general obligation bonds that may be issued for any purpose is generally limited, in the aggregate, to twenty percent (20%) of the assessed value of the County, and approximately Two Million Five Hundred Thousand Dollars ($2,500,000) of the aggregate amount will be expended for purposes that are subject to this 20% limitation.  For purposes of the 20% limitation, the County has Five Million One Hundred Ten Thousand Four Hundred Seventy-five Dollars ($5,110,475) principal amount of general obligation bonds outstanding.  Approximately Two Million Five Hundred Thousand Dollars ($2,500,000) of the aggregate amount of bonds issued for the proposed purposes herein are subject to a limitation of fifteen percent (15%) of the assessed value of the County.  For purposes of the 15% limitation, the County has Five Million One Hundred Ten Thousand Four Hundred Seventy-five Dollars ($5,110,475) principal amount of general obligation bonds outstanding.  Accordingly, the issuance of the Bonds for these purposes will not exceed any debt limitation prescribed by law, including the limitations imposed by Section 19-9-5 of the Code.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE COUNTY AS FOLLOWS:
SECTION 1. The Governing Body of the County does hereby declare its intention to issue the Bonds of the County in the principal amount not to exceed Two Million Five Hundred Thousand Dollars ($2,500,000) to be used for the purpose of providing funds to pay for the cost of (i) constructing, reconstructing, and repairing roads, highways and bridges, and acquiring the necessary land, including land for road building materials, acquiring rights-of-way therefor; and the purchase of heavy construction equipment and accessories thereto reasonably required to construct, repair and renovate roads, highways and bridges and approaches thereto within the County; (ii) paying the costs of issuing the bonds; and (iii) other related improvements within the County.
SECTION 2. The Bonds will be general obligations and will be secured by a special tax levied annually on all taxable property within the County in an amount which will be sufficient to pay the principal and interest on the Bonds as each becomes due and payable.
SECTION 3. The Governing Body reasonably expects that a portion of the cost of the Project in the maximum amount set forth above will be reimbursed from the proceeds of the Bonds.  This Resolution is being adopted as required by and in order to comply with the “Reimbursement Rules” set forth in the Internal Revenue Code of 1986 and the rules and regulations promulgated thereunder including specifically Internal Revenue Code Regulation 1.150-2 and appearing at 58 Federal Register 33510 and with the laws of the State of Mississippi.  The Governing Body reasonably expects to make the reimbursement allocation from the proceeds of the Bonds to the respective fund or accounts of the County from which the capital expenditures have been made no later than eighteen (18) months after the later of the date of the expenditure or the date that the Project is placed in service, but in no event more than three (3) years after the date of the first expenditure.
SECTION 4.    The Governing Body proposes to direct the issuance of all or any portion of the Bonds in the amount and for the aforesaid purposes at a meeting of the Governing Body to be held at its regular meeting place at the Chancery Building in Yazoo City, Mississippi, at ten o’clock (10:00 a.m.) on Monday, the 6th day of August, 2012, or at some meeting held subsequent thereto.  If twenty percent (20%) or fifteen hundred (1,500), whichever is less, of the qualified electors in the County shall file a written protest with the Clerk of the County against the issuance of the Bonds on or before the aforesaid date and hour, then the Bonds shall not be issued unless authorized at an election on the question of the issuance of the Bonds.  Such election shall be called and held as provided by law.  If no protest is filed, then the Bonds may be issued without an election on the question of the issuance thereof at any time within a period of two (2) years after the date above specified.
SECTION 5. This Resolution shall be published once a week for at least three (3) consecutive weeks in The Yazoo Herald, a newspaper having a general circulation in the County and qualified under the provisions of Section 13-3-31 of the Code.  The first publication of this Resolution shall be made not less than twenty-one (21) days prior to August 6, 2012, and the last publication shall be made not more than seven (7) days prior to such date, said Resolution to be published on or about July 11, July 18, July 25, and August 1, 2012.
SECTION 6. The Clerk of the County shall be and hereby is directed to procure from the publisher of the aforesaid newspaper the customary proof of said publication of this Resolution and have same before the Governing Body on the date and hour specified in Section 4 hereof.

The two parcels conveyed hereby are separated by a Parcel 28 feet in width by 140 feet in length measured back from Powell Street and belonging to the grantor herein.
