WHEREAS, on November 2, 2007, William T. Kuhn a/k/a William M. Kuhn and Terri J. Kuhn, a married couple, executed a Deed of Trust to Tim Williams, Trustee for the benefit of 21st Mortgage Corporation, as recorded in the office of the Chancery Clerk of Yazoo County, Mississippi, in Book 392B at Page 77, reference to which is hereby made; and
WHEREAS, said 21st Mortgage Corporation, under the power granted to it in said Deed of Trust, by instrument dated May 18, 2011, duly spread upon the record and recorded in Book 393B at Page 162, in the office of the Chancery Clerk aforesaid, did substitute the undersigned Marc K. McKay in the place and stead of the original Trustee and of any other Substituted Trustee;
WHEREAS, default having been made by said William T. Kuhn a/k/a William M. Kuhn and Terri J. Kuhn in the payment of the above mentioned indebtedness as it fell due, and payment having been requested by 21st Mortgage Corporation, the legal holder of the indebtedness secured by and described in the above mentioned Deed of Trust;

and for other relief as set forth in the Petition.  The Petition in this matter is on file in the records in the office of the Mississippi State Oil and Gas Board and may there be examined.
The Petition will be heard by said Board at 10:00 a.m. on the 19th day of September, 2012, at 500 Greymont Avenue, Suite E, Jackson, Mississippi 39202, at which time and place you may appear and contest said matter.
If you intend to contest the Docket or request a continuance you must notify the Board and the Petitioner's representative of your intention in writing not later than 5:00 p.m. Tuesday, September 11, 2012, which is seven (7) days prior to the date stated above for the hearing.  Failure to so notify the Board and the Petitioner's representative shall be a waiver of your right to contest or request a continuance.
You are advised the Board may adopt an order concerning a Petition which may differ from the relief requested by the Petitioner and the Board will enter such order or orders as in its judgment may be appropriate in accordance with the evidence presented.

SUBSTITUTED TRUSTEE'S
NOTICE OF SALE

WHEREAS, on November 2, 2007, William T. Kuhn a/k/a William M. Kuhn and Terri J. Kuhn, a married couple, executed a Deed of Trust to Tim Williams, Trustee for the benefit of 21st Mortgage Corporation, as recorded in the office of the Chancery Clerk of Yazoo County, Mississippi, in Book 392B at Page 77, reference to which is hereby made; and
WHEREAS, said 21st Mortgage Corporation, under the power granted to it in said Deed of Trust, by instrument dated May 18, 2011, duly spread upon the record and recorded in Book 393B at Page 162, in the office of the Chancery Clerk aforesaid, did substitute the undersigned Marc K. McKay in the place and stead of the original Trustee and of any other Substituted Trustee;
WHEREAS, default having been made by said William T. Kuhn a/k/a William M. Kuhn and Terri J. Kuhn in the payment of the above mentioned indebtedness as it fell due, and payment having been requested by 21st Mortgage Corporation, the legal holder of the indebtedness secured by and described in the above mentioned Deed of Trust;
WHEREAS, the undersigned was called upon to execute the Trust therein contained, the owner of the indebtedness secured by said Deed of Trust having declared it due and payable, and to sell said property under the provisions of said Deed of Trust for the purpose of raising said sum so secured and unpaid, together with the expenses of selling same, including Trustee's and attorneys fees;
NOW, THEREFORE, I, the undersigned Marc K. McKay being the Substituted Trustee, do hereby give notice that on September 18, 2012, between 11:00 o'clock a.m. and 4:00 o'clock p.m., being the legal hours of sale, I will proceed to sell at public outcry, to the highest bidder for cash, at the South Front Door of the Yazoo County Courthouse in Yazoo City, State of Mississippi, the following real property described and conveyed in said Deed of Trust, lying and being situated in Yazoo County, Mississippi, and being more particularly described as follows, to-wit:
Description of a 25.13 + or - acre parcel of real property located in the NE 1/4 of Section 18, T12N, R1E, Yazoo County, Mississippi further described as follows:
Beginning at an iron pin located 851.00 feet south of the northeast corner of Section 18, T12N, R1E, Yazoo County, Mississippi run thence west a distance of 1274.20 feet to an iron pin; run thence south a distance of 859.00 feet to an iron pin; run thence east a distance of 1274.20 feet to an iron pin; run thence North a distance of 859.00 feet to the Point of Beginning containing 25.13 acres.
Together with a 24 foot wide, non-exclusive ingress-egress access easement along the north boundary of a 12 + or - acre parcel described in Deed Book 286A Page 561 of the Yazoo County records, the boundary of said easement being 12 feet either side of the following described centerline: Beginning at a point located 863.00 feet south of the northeast corner of Section 18, T12N, R1E, Yazoo County, Mississippi run thence west a distance of 636.40 feet to the centerline of a gravel drive and Point of Termini of said 24 foot wide easement.
Also, together with: A 12 foot wide, non-exclusive ingress-egress access easement along an existing gravel drive across a 33 + or - acre parcel described in Deed Book 115A, Page 353 of the Yazoo County records; the boundary of said easement being 6 feet either side of the following described centerline: Beginning at the Point of Termini of the above described easement, run thence along an existing gravel drive with the following calls: North 26 degrees 55 minutes 43 seconds East a distance of 139.62 feet; thence North 38 degrees 40 minutes 55 seconds east a distance of 141.81 feet; thence North 51 degrees 31 minutes 14 seconds east a distance of 226.26 feet; thence North 39 degrees 02 minutes 33 seconds east a distance of 162.79 feet; thence North 23 degrees 05 minutes 28 seconds east a distance of 87.99 feet; thence North 16 degrees 52 minutes 00 seconds east a distance of 254.85 feet to the Point of Termini of said easement at the pavement edge of Edon-Midway Road.
Also included a 2007 Southern Mobile Home, 80x32 with the Serial Number DSD4AL51025AB
I will convey only such title as is vested in me as Substituted Trustee.
