WHEREAS, on October 29, 2001, Cynthia Miller executed a Deed of Trust to NONE STATED as Trustee for the benefit of Homeowners Loan Corp, which Deed of Trust was recorded in Book 275B, Page 0284 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and    WHEREAS, Homeowners Loan Corp assigned said Deed of Trust to Bankers Trust Company as Trustee pursuant to an instrument dated October 29, 2001 and recorded in Book 282B, Page 647 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and
WHEREAS, Deutsche Bank Trust Company Americas fka Bankers Trust Company, as Trustee, the holder of said Deed of Trust and the Note secured thereby, appointed Michael S. McKay as Trustee therein as authorized by the terms thereof, as evidenced by an instrument dated November 29, 2004 and recorded Book 319B, Page 265 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and    WHEREAS, the afore-mentioned Assignment of Deed of Trust was re-recorded in Book 353B, Page 0318 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and

WHEREAS, Deutsche Bank National Trust Company fka Bankers Trust Company as Trustee assigned said Deed of Trust to Deutsche Bank National Trust Company Americas as Trustee for RASC 2002KS1 pursuant to an instrument dated September 30, 2008 and recorded in Book 366B, Page 239 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and
WHEREAS, Deutsche Bank National Trust Company Americas as Trustee for RASC 2002KS4, the holder of said Deed of Trust and the Note secured thereby, substituted Emily Kaye Courteau as Trustee therein in place of the afore-mentioned original Trustee, as authorized by the terms thereof, as evidenced by an instrument dated September 30, 2008 and recorded Book 366B, Page 0240 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and
WHEREAS, on July 28, 2010, Homecomings Financial, Inc. executed an Affidavit of Lost Assignment” which states that Homecomings Financial, Inc. was the mortgagee as a result of a sale and assignment from Deutsche Bank and National Trust Company Americas as Trustee for RASC 2002KSI; said Affidavit having been recorded in Book 385B, Page 204 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and
WHEREAS, Homecomings Financial, LLC assigned said Deed of Trust to  Home Solutions Partners III, LP pursuant to an instrument dated July 28, 2010 and recorded in Book 385B, Page 206 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and
WHEREAS, Home Solutions Partners III, LP assigned said Deed of Trust to Transportation Alliance Bank, Inc. pursuant to an instrument dated February 9, 2012 and recorded in Book 400B, Page 0334 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and    WHEREAS, Transportation Alliance Bank, Inc., the holder of said Deed of Trust and the Note secured thereby, substituted Scot P. Goldsholl as Trustee in place of the afore-mentioned original Trustee and the afore-mentioned substituted Trustee, as authorized by the terms thereof, as evidenced by an instrument dated October 29, 2012, and recorded in Book 410B, Page 0292 in the Office of the Chancery Clerk of Yazoo County, Mississippi; and    WHEREAS, the afore-mentioned Appointment of Substitute Trustee recorded in Book 410B, Page 0292 in the Office of the Chancery Clerk of Yazoo County, Mississippi was amended and re-recorded in Book 411B, Page 0123 in said records; and     
WHEREAS, default having been made in the terms and conditions of said Deed of Trust, and the entire debt secured thereby having been declared to be due and payable, and the legal holder of said indebtedness, Transportation Alliance Bank, Inc., having requested the undersigned Substitute Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee's fees and expenses of sale.
