WHEREAS, on June 28, 1991, Raymond E. Thomas, single and Cenoel Thomas, single and Henrietta Reed, single executed a certain deed of trust to Robert G. Barnett, Trustee for the benefit of Deposit Guaranty Mortgage Company which deed of trust is of record in the office of the Chancery Clerk of Yazoo County, State of Mississippi in Book 165B at Page 341; and
WHEREAS, Safety- Guard Mfg. Co., Inc. obtained interest in subject property by Quitclaim Deed dated December 7, 1998 and recorded in Book 261A at Page 545 of the aforesaid Chancery Clerk's Office; and
WHEREAS, said Deed of Trust was subsequently assigned to MidFirst Bank by instrument dated July 17, 1999 and recorded in Book 251B at Page 773 of the aforesaid Chancery Clerk's office; and
WHEREAS, MidFirst Bank has heretofore substituted J. Gary Massey as Trustee by instrument dated January 20, 2000 and recorded in the aforesaid Chancery Clerk's Office in Book 252B at Page 655; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, MidFirst Bank, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.

NOTE:    
By order of the Board of Education, advance payment of lease and certification of  Insurability will be required on all leases, due upon execution of Contract. (within fifteen days of awarding lease) 5% of bid amount will be made payable in the form of cashier’s check or money order at the time of bid. (Refundable if bid not successful)  A security deposit in the amount of 1 year’s tax will be paid at the execution of the Contract.  An $8.00 per acre minimum is required for the bid to be valid.    
The County Board of Education reserves the right to execute timber deeds; oil, gas and mineral leases; and deed for rights of way serving power, gas, telephone lines and public roads.    
All leases will be subject to the laws of Mississippi regarding the use of timber upon Sixteenth Section lands.
Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees, guests or invitees, in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to protect Lessor from any and all damages or claims arising out of Lessees acts in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to waive informalities.

REQUEST FOR PROPOSALS
This is a Request for Proposals for qualified firms or individuals to provide Appraisal, Legal, Administrative and Consulting Engineering Services for the City of Yazoo’s MDA’s EDH award, and potential funds from the US Department of Commerce’s Economic Development Administration (EDA), to construct a parkway connecting US HWY 49 to MS HWY 3 (Willie Morris Parkway) in Yazoo City, Mississippi.
The contracts will be awarded to the responsible offerors whose proposal is within the competitive range and determined to be the most advantageous to the City, price and other factors considered.  The factors to be considered in evaluation of proposals and their relative importance are set forth below:
APPRAISAL:  Consultation services shall include examination of property records related to any easements, rights-of-way, or other land purchases in regards to proposed project.  Knowledge of federal land procurement is a necessity.  An Appraiser, as well as a Review Appraiser will be selected.  The firm receiving the highest point total will be selected as Appraiser with the firm receiving the second highest points to be selected as Review Appraiser.  The Appraiser and Review Appraiser selected will be subject to negotiation of fair and reasonable compensation prior to award of contract.
LEGAL:  Consultation services as required for the implementation of the proposed improvements in accordance with State and Community Development Block Grant prescribed rules, Federal Regulations, policies and State law.  Legal services shall include but not be limited to consultation services, the evaluation of all contracts and land acquisition, etc.  The contract will be on an hourly basis.
ENGINEER: The Contractor shall perform all the necessary engineering services to properly carry-out the activities in the project in accordance with State and HUD prescribed rules, regulations, policies, and State law.  The project includes the following activities:
A. Prepare plans and specifications for project.
B. Construct and distribute bid packets (insuring that all Federal and State requirements are met in contract preparation).
C. Assist in bid opening and prepare bid tabulation.
D. Conduct pre-construction conference with contractor and staff representatives, documenting files with minutes of meeting.
E. Conduct work-in-progress inspections giving periodic reports to the City and approving any and all partial payment requests.
Firms interested in providing these services may so indicate by furnishing the City  three (3) copies of the following:
A cover letter specifying the name of the project manager and the location and address of the office to be assigned the majority of the work;
A resume for each principal member, the project manager, and employee(s) of the firm anticipated to be assigned to the project.  Also, provide an organizational chart and list each person's experience and qualifications.  Engineering firms should include proof that the Project Manager is licensed as a Mississippi Professional Engineer and that the firm has met state licensure and certification requirements;
A description of similar type work completed during the past five (5) years which qualifies the consultant for this work; the cost and schedule completion (or actual completion) of this work.
A response containing the information upon which the consultant will be evaluated.
Those desiring consideration should submit proposals by the time and date stated above and must include the following:
1. Qualifications - List of qualifications of each staff person to be assigned to project.
2. Experience - Information regarding the experience of the firm.  This should include types of projects undertaken.
3. Capacity for Performance - Identify the title of staff available to be assigned to provide services.
All proposals will be rated on the following system to determine the best offer or:  Description and maximum points: Qualifications - 40; Experience - 40; Capacity - 20; Total 100 points.
Proposals will be reviewed by the selection committee using the above selection criteria.  A written contract will be awarded to the firm whose proposal is within the competitive range and determined by the committee to be the most advantageous to the City, price and other factors considered.  The contract will include scope and extent of work and other essential requirements.
The City of Yazoo City reserves the right to reject any and all proposals and all awards are contingent upon receiving funding from EDH and EDA.

WHEREAS, on June 28, 1991, Raymond E. Thomas, single and Cenoel Thomas, single and Henrietta Reed, single executed a certain deed of trust to Robert G. Barnett, Trustee for the benefit of Deposit Guaranty Mortgage Company which deed of trust is of record in the office of the Chancery Clerk of Yazoo County, State of Mississippi in Book 165B at Page 341; and
WHEREAS, Safety- Guard Mfg. Co., Inc. obtained interest in subject property by Quitclaim Deed dated December 7, 1998 and recorded in Book 261A at Page 545 of the aforesaid Chancery Clerk's Office; and
WHEREAS, said Deed of Trust was subsequently assigned to MidFirst Bank by instrument dated July 17, 1999 and recorded in Book 251B at Page 773 of the aforesaid Chancery Clerk's office; and
WHEREAS, MidFirst Bank has heretofore substituted J. Gary Massey as Trustee by instrument dated January 20, 2000 and recorded in the aforesaid Chancery Clerk's Office in Book 252B at Page 655; and

NOTE:    
By order of the Board of Education, advance payment of lease and certification of  Insurability will be required on all leases, due upon execution of Contract. (within fifteen days of awarding lease) 5% of bid amount will be made payable in the form of cashier’s check or money order at the time of bid. (Refundable if bid not successful)  A security deposit in the amount of 1 year’s tax will be paid at the execution of the Contract.  An $8.00 per acre minimum is required for the bid to be valid.    
The County Board of Education reserves the right to execute timber deeds; oil, gas and mineral leases; and deed for rights of way serving power, gas, telephone lines and public roads.    
All leases will be subject to the laws of Mississippi regarding the use of timber upon Sixteenth Section lands.
Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees, guests or invitees, in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to protect Lessor from any and all damages or claims arising out of Lessees acts in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to waive informalities.

A public hearing as required by law will be conducted by the Yazoo County School Board on Tuesday June 28, 2011, prior to the Recessed Board Meeting. The purpose of the hearing is to give the citizens of the Yazoo County School District an opportunity to comment on the expenditures and taxing plans of the district. Items to be discussed are the District’s Budget, Special Education Funding, Preschool Funding as well as Federal Program Funding.

The meeting will be held at the Courthouse Annex in the Boardroom of the Yazoo County Board of Supervisor’s Office. The hearing will begin at 6:00 p.m.
