The undersigned will receive sealed bids until 2:00 o’clock p.m., Tuesday September 6, 2011, for the following hunting leases for a period of five (5) years, beginning September 7, 2011 and ending August 31, 2016.

That portion of Sixteenth Section, Township 10, Range 2 East, containing approximately 583.0 acres, currently leased to Kevin Mahaffey and/or Tim Mahaffey.

That portion of Sixteenth Section, Township 10, Range 2 West, containing approximately 648.0 acres, currently leased to Silver Creek Hunting Partners, LLC.
NOTE:    
By order of the Board of Education, advance payment of lease and certification of  Insurability will be required on all leases, due upon execution of Contract. (within fifteen days of awarding lease) 5% of bid amount will be made payable in the form of cashier’s check or money order at the time of bid. (Refundable if bid not successful)  A security deposit in the amount of 1 year’s tax will be paid at the execution of the Contract.  An $8.00 per acre minimum is required for the bid to be valid.    
The County Board of Education reserves the right to execute timber deeds; oil, gas and mineral leases; and deed for rights of way serving power, gas, telephone lines and public roads.    
All leases will be subject to the laws of Mississippi regarding the use of timber upon Sixteenth Section lands.
Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees, guests or invitees, in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to protect Lessor from any and all damages or claims arising out of Lessees acts in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to waive informalities.

Contract Time
The owner has established a contract performance time of _90_calendar days from the date of the Notice-to-Proceed.  All project work shall be substantially completed within the stated timeframe.  This project is subject to liquidated damages as prescribed within the project manual.
Bid Security
Each proposal must be accompanied by a bid guaranty in the amount of five (5%) percent of the total amount of the bid.  The bid guaranty may be by certified check or bid bond made payable to Yazoo County.
Bonding Requirements
The successful bidder will be required to furnish separate performance and payment bonds each in the amount equal to 100% of the contract price at the time of contract execution.
Award of Contract
All proposals submitted in accordance with the instructions presented herein will be subject to evaluation. Bids may be held by the Yazoo County  for a period not to exceed 30 days from the date of the bid opening for the purpose of conducting the bid evaluation.
Award of contract will be based on the lowest aggregate sum proposal submitted from those bidders that are confirmed as being responsive and responsible. The right is reserved, as the Yazoo County may require, to reject any and all bids and to waive any informality in the bids received.
Award of contract is contingent upon the owner receiving Federal funding assistance under the Airport Improvement Program.
Federal Provisions
This project is subject to the following Federal provisions, statutes and regulations;
Equal Employment Opportunity - Executive Order 11246 and 41 CFR Part 60:  The Bidder’s attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications" set forth within the supplementary provisions. The successful Bidder shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin.  The Contractor will take affirmative action to ensure that applicants are employed, and that employees are treated during employment without regard to their race, color, religion, sex, or national origin.
Goals for Minority and Female Participation – Executive Order 11246 and 41 CFR Part 60:
1. The Bidder’s attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract Specifications" set forth within the supplementary provisions.
2. The goals and timetables for minority and female participation, expressed in percentage terms for the contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:
Overall DBE Goal is 10.66%
These goals are applicable to all of the contractor's construction work (whether or not it is Federal or federally-assisted) performed in the covered area.  If the contractor performs construction work in a geographical area located outside of the geographical area where the work is actually performed.  With regard to this second area, the contractor also is subject to the goals for both its Federally involved and non-federally involved construction.
Certification of Nonsegregated Facilities – 41 CFR Part 60: A certification of Nonsegregated Facilities must be submitted prior to the award of a federally-assisted construction contract exceeding $10,000 which is not exempt from the provisions of the Equal Opportunity Clause.
Contractors receiving federally assisted construction contract awards exceeding $10,000, which are not exempt from the provisions of the Equal Opportunity Clause will be required to provide for the forwarding of the notice to prospective subcontractors for supplies and construction contracts where the subcontracts exceed $10,000 and are not exempt from the provisions of the Equal Opportunity Clause.  The penalty for making false statements in offers in prescribed in 18 U.S.C. 1001.
Davis-Bacon Act, as amended – 29 CFR Part 5: The Contractor is required to comply with wage and labor provisions and to pay minimum wages in accordance with the current schedule of wage rates established by the United States Department of Labor.
Debarment, Suspension, Ineligibility and Voluntary Exclusion – 49 CFR Part 29: The bidder certifies, by submission of a proposal or acceptance of a contract, that neither it nor its principals are presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency.  Individuals or companies listed in the General Services Administration’s “Excluded Parties Listing System” will not be considered for award of contract.
Foreign Trade Restriction – 49 CFR Part 30
The Bidder and Bidder’s subcontractors, by submission of an offer and/or execution of a contract, is required to certify that it:
a.  is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms published by the Office of the United States Trade Representative (USTR);
b.  has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country on said list, or is owned or controlled directly or indirectly by one or more citizens or nationals of a foreign country on said list;

Buy American Certificate – Aviation Safety and Capacity Act of 1990:
This contract is subject to the “Buy American Preferences” of the Aviation Safety and Capacity Act of 1990.  Prospective Bidders are required to certify that steel and manufactured products have been produced in the United States and to clearly identify those items produced or manufactured outside of the United States.

Grenada Railway LLC (“GRYR”) gives notices that on or about September 15, 2011, it intends to file with the Surface Transportation Board, Washington, DC 20423 (“Board”) a petition for exemption under 49 U.S.C. 10502 from the prior approval requirements of 49 U.S.C. 10903, et seq., to abandon its little used railroad line between Milepost 622.5 near Grenada and Milepost 703.8 near Canton, a distance of 81.3 miles in Grenada, Montgomery, Carroll, Holmes, Yazoo and Madison Counties, MS. The line traverses United States Postal Service Zip Codes 38960, 38926, 38925, 38967, 39176, 39192, 39063, 39079, 39146, and 39179, which are the Zip Codes for the stations on the line, Tie Plant, Elliott, Duck Hill, Eskridge, Winona, Vaiden, West, Durant, Goodman, Pickens and Vaughan. The proceeding before the Board has been docketed at No. AB-108TX.
Based on information in GRYR’s possession, the line includes no federally granted rights-of-way. Any documentation in GRYR’s possession will be made available promptly to those requesting it.
The interests of railroad employees will be protected by the conditions of Oregon Short Line R. Co. -Abandonment-Goshen, 360 I.C.C. 91 (1979).
The Board’s Office of Environmental Analysis (“SEA”) generally will prepare and Environmental Assessment (“EA”), which will normally be available 60 days after the filing of the petition for abandonment exemption. Comments on environmental and energy matters should be filed no later than 30 days after the EA becomes available to the public and will be addressed in a Board decision. WHEREAS, Section 25-41-11 of the Mississippi Code of 1972, as amended  indicates that minutes of a public body whether in open or executive session shall be taken and shall include a record of the votes taken; and
WHEREAS, the Code of Ordinances for the City of Yazoo does not authorize the taking of votes in executive session but only in an open meeting; and
WHEREAS,  the governing authorities believe that the best interests of the City of Yazoo City Mississippi would be served by allowing votes to be taken in executive session;
NOW THEREFORE BE IT ORDAINED by the Board of Mayor and Aldermen of Yazoo City, in council convened that Section 2-2 (a) of the Code of Ordinances for Yazoo City shall be amended to read as follows: (a) The governing body and all boards, agencies and departments of the city shall conduct their business in open and public sessions fully accessible to the general public except when an executive session is declared.   Executive session may only be declared for any subject matter authorized and the  procedure mandated in Section 25-41-7 of the Mississippi Code of 1972,  as amended.  Votes may be taken in executive session provided the vote concerns only the subject matter for which the executive session was specifically convened.  Votes and final actions taken in executive sessions shall be recorded and included in the minutes as provide by state law .
This ordinance shall become effective thirty (30) days from and after passage and publication.

ORDINANCE ESTABLISHING RESIDENCY REQUIREMENTS
FOR MEMBERS OF BOARDS AND COMMISSIONS WITHIN THE CITY OF YAZOO CITY, MISSISSIPPI
WHEREAS, the City of Yazoo is a special charter municipality organized and existing pursuant to the laws of the State of Mississippi; and
WHEREAS, Section 7 of the City of Yazoo’s special charter vests with its mayor and aldermen full power to establish rules for its own government; and
WHEREAS,  consistent with Section 7 of the City of Yazoo’s special charter, the governing authorities establish certain boards and commissions and assign to each various governmental responsibilities and functions; and
WHEREAS,  the governing authorities believe that the best interests of the citizenry of Yazoo City Mississippi would be served by establishing residency requirements for members of its various boards and commissions;
NOW THEREFORE BE IT ORDAINED by the Board of Mayor and Aldermen of Yazoo City, Mississippi in council convened:
(1) All members of boards and commissions of the City of Yazoo except the Yazoo Municipal Separate School District and the Yazoo City Housing Authority shall be residents of the City of Yazoo, Mississippi.
(2) The members of the Yazoo City Housing Authority shall be residents of the City of Yazoo and/or residents of an area  within five (5) miles of the territorial boundaries of the City of Yazoo.  [Ref. Section 43-33-1 and AG Opinion # 2009-00015 Notter, February 13, 2009,}   
(3) The members of the Yazoo Municipal Separate School District Board of Trustees shall be comprised of qualified electors and residents of the City of Yazoo, Mississippi; however, if added territory of the district  furnishes fifteen percent (15%) or more of the pupils enrolled in the schools of the district, then at least one (1) member of the Board of the Trustees shall be a qualified elector and resident of the added territory outside the corporate limits.  If the added territory of the school district furnishes thirty percent (30%) or more of the pupils enrolled, then no more than two members of the board shall be qualified electors and residents of the added territory outside the corporate limits. [Ref. MCA 37-7-203].
(4) If any part of this ordinance is declared unconstitutional, illegal, or void, it shall not affect or impair any of the remaining parts of this ordinance.
(5) This ordinance shall become effective thirty (30) days from and after passage and publication.

Manor, An unmarried Woman, executed a certain deed of trust to Denise McLaurin, Trustee for the benefit of Mortgage Electronic Registration Systems, Inc., which deed of trust is of record in the office of the Chancery Clerk of Yazoo County, State of Mississippi in Book 383B at Page 0167; and

REQUEST FOR PROPOSALS
Yazoo County will receive sealed proposals from qualified persons or firms for services required by their 2010 HOME Housing program. The proposals will be rated according to the following on criteria:(1) Qualifications - 5 points; (2) Grant Experience - 5 points; (3) Capacity to perform work - 5 points; and (4) Cost per unit -5 points. The County is seeking professional Legal and certified asbestos inspection services on their funded housing project.
The proposers should be familiar with the Mississippi Development Authorities HUD/HOME requirements, rules and regulations that will be used on this undertaking. Licensed and experienced building contractors wanting to bid on this project should complete a Building Contractors Application from the Supervisors Office in the Yazoo County Building or the HOME Grant Administrator.
These proposals are requested in accordance with current state law and 24 CFR Part 85 “Common Rule”. The contract will be awarded to the qualified proposers, whose proposal is determined to be most advantageous to the County. The Board reserves the right to reject any or all proposals, and to waive any informalities or irregularities in the proposal process.
Proposals must be submitted to the Yazoo County, Attn: County Administrator, P. O. Box 1106, Yazoo City, Mississippi 39194 on or before 10:00 a.m., August 1, 2011. At this time the proposals will be opened and read aloud.

The County Board of Education reserves the right to execute timber deeds; oil, gas and mineral leases; and deed for rights of way serving power, gas, telephone lines and public roads.    
All leases will be subject to the laws of Mississippi regarding the use of timber upon Sixteenth Section lands.
Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees, guests or invitees, in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to protect Lessor from any and all damages or claims arising out of Lessees acts in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to waive informalities.
