REQUEST FOR PROPOSALS TO PROVIDE GROUP INSURANCE FOR THE CITY OF YAZOO CITY, MISSISSIPPI

The City of Yazoo City (the “City”) is soliciting proposals from qualified insurance carriers to provide comprehensive medical insurance coverage and also dental and optical to its employees beginning January 1, 2012 and ending December 31, 2012.  In addition to dental and optical, the City would like to provide life insurance coverage for its employees.  The City employs approximately 112 employees and is interested in cost effective products satisfying the requirements of recently enacted Healthcare Reform Legislation.  Proposals for the provision of medical, dental, and optical or for dental or optical only will be received until 12:00 p.m., November 28, 2011, in the Office of the City Clerk located at 128 E. Jefferson Street, Yazoo City, Mississippi 39194.

The contract to provide comprehensive medical insurance coverage an also dental, optical and life will be awarded to the Respondent determined by the City to be the best Respondent.

The City reserves the right to reject any and all Proposals for any reason at any time prior to execution of a contract with the Respondent selected by the City to provide comprehensive medical insurance coverage and also dental, optical, and life insurance; and to waive any and all formalities in the process.

REQUEST FOR BIDS
The Yazoo County Board of Supervisors are assisting Four homeowners accept sealed bids for the demolition of their existing unit and the contruction of the new replacement unit on the same lot. The bids are requested through the Mississippi Development Authority’s HOME grant program and all bidders are required to have a "Residential Builders License" and Proof of Insurance submitted to the County along with the completed Contractor’s Qualification and References Form prior to bidding. The form is available from the County or the Grant Adminstrator (Coker Consultants 662-627-2215)
The bid should be turn-key demolition, proper disposal, site preparation, 6 sets of plans and the construction of the new unit according to the plans and specifications. The project includes one (1) 3-Bedroom Unit "Montague" Plan, (2) 3-Bedroom Units "Winchester" Plan and (1) 3-Bedroom/2 Bathroom "Manufactured Unit", 16'x76' to replace an existing manufactured unit. The plans and specifications for all four (4) units along with the bid packets can be picked up or reviewed at the Yazoo County Board of Supervisors office or from the Grant Administrators office (662-627-2215). The Montague and Winchester plans are available to purchase ($8.00) from Jackson Blueprint (601-353-5803) and include all the specific MDA specifications.
A mandatory pre-bid conference will be held at the Yazoo County Supervisors Board Room on Tuesday November 8 at 2:00 P.M. Only the contractors attending this Pre-Bid Conference will be eligible to submit bids on Tuesday November 29, 2011 at 11:00 A.M. All bids should be sealed and delivered prior to 11:00 A.M. to the Yazoo County HOME Grant homeowners at the Yazoo County Board of Supervisors Office, P.O. Box 1106, Yazoo City, Ms 39194. STATEMENT OF FINDINGS AND PUBLIC EXPLANATION
Floodplain Management Executive Order (EO) 11988
To: All Interested Agencies, Groups and Individuals
This is to give notice that the City of Yazoo City has analyzed the project identified below, as required by Presidential directive EO 11988 and determined that assistance should be granted therein.  The proposed project consists of the following:
CONSTRUCTION OF YAZOO CITY AMTRAK STATION IN YAZOO CITY
The City of Yazoo City has determined there are no practical alternatives.  The alternatives considered by the City are listed below:
1. No Action.  This alternative will not remove existing non-compliant ADA conditions and concerns for safety.  
2. Alternate design.  This is possible; however, there are no environmental conditions that are significantly affected by the proposed train station.      
3. Continue with project as planned.  This alternative is the most advantageous.  The train station will not significantly affect the environment.      
The City of Yazoo City has determined that this project will not have a significant impact on the environment. The City recommends that the following mitigation measures should be used to minimize adverse environmental impacts and restore or enhance environmental quality.
The Contractor will obtain all necessary permits for the proposed project.
If any cultural resources are found during construction; construction will stop and MDAH will be contacted.  
In the case where any unanticipated wetlands are discovered during construction; construction will stop and the CORPS will be notified.  
Since this project is located in a base (100-year frequency) floodplain established by the Federal Emergency Management Agency (FEMA) EO 11988 may deny assistance to this project unless there is no practical alternative to doing so.  An analysis by the City of Yazoo City indicates there is no practical alternative.  The basis for this determination is as follows:
1. It is not possible to carry out the objectives of the TIGER program and participate in the growth plan of the community without participating in projects in the base floodplain;
2. The proposed construction will not displace or redirect flood waters to seriously impact other areas; and,
3. Construction will be in compliance with the Floodplain Management Plan prepared by the community as a condition of their participation in the National Flood Insurance Program.
Any comments received as a result of the Early Public Notice for this project on
November 4, 2011, were considered in the analysis which can be reviewed at City Hall.  Such comments should be sent to the address given below.  This project will not be implemented without considering public comments. Written comments must be received by the City of Yazoo City, Post Office Box 689, Yazoo City, Mississippi 39194 on or before November 21, 2011.  
The publication of this Notice complies with Section 2(a)(2) of the Order, and it applies to all project actions located within or impacting the floodplain.

Take notice that Denbury Onshore, LLC (the “Applicant”) has filed an administrative permit application with the Mississippi State Oil and Gas Board requesting authority to convert the TFU 32-12 #2 (“the Well”) to be utilized as an approved Class II CO2 or Saltwater enhanced oil recovery injection well, Tinsley Field, Yazoo County, Mississippi.
The Well location is 2,084’ from the south line and 437’ from the west line of Section 32, Township 10 North, Range 2 West, Yazoo County, Mississippi.
Applicant requests authority to convert said well to be utilized as an approved Class II CO2 or Saltwater enhanced oil recovery injection well in the unitized Tinsley Field Unit, Tinsley Field with the top of the injection interval at of 4,960 feet below the surface in said well. The well will be utilized for pressure maintenance and tertiary recovery operations on the Field Unit, a compulsory fieldwide unit in the Tinsley Field.
Applicant’s administrative permit application in this matter is on file in the offices of the Mississippi State Oil and Gas Board located at 500 Greymont Avenue, Suite E, Jackson, Mississippi 39202, where it is available for public inspection during usual business hours.
Any interested persons wishing to submit written comments to the Mississippi State Oil and Gas Board regarding this administrative permit application must do so within twenty (20) days following the publication of this public notice.

WHEREAS, the Board of Mayor and Aldermen of the City of Yazoo City, Mississippi (the "Governing Body"), acting for and on behalf of the City of Yazoo City, Mississippi (the "City"), is authorized by Sections 21-33-301 et seq., Mississippi Code of 1972, as amended, and Sections 17-17-301 et seq., Mississippi Code of 1972, as amended, including specifically Section 17-17-329 thereof (collectively, the "City Bond Act"), to issue general obligation bonds for the purposes set forth therein, including, but not limited to, (a) erecting municipal buildings and purchasing buildings or land therefor, and for repairing, improving, adorning and equipping the same, (b) establishing sanitary, storm, drainage or sewerage systems, and repairing, improving and extending the same, and (c) constructing, improving or paving streets, sidewalks, driveways, parkways, walkways or public parking facilities and purchasing land therefore (the "Project"); and
WHEREAS, the Governing Body, acting for and on behalf of the City, is also authorized under the City Bond Act and Sections 31-25-1 et seq., Mississippi Code of 1972, as amended (the "Bank Act"), and other applicable laws of the State of Mississippi (the "State"), to (a) issue a general obligation bond of the City to be sold to the Mississippi Development Bank (the "Bank") to finance the costs of the Project, or (b) enter into a loan with the Bank to borrow money to finance the costs of the Project; and

WHEREAS, the Project is in accordance with and in furtherance of the provisions of the City Bond Act and the Bank Act; and
WHEREAS, the Governing Body is authorized pursuant to the City Bond Act and/or the Bank Act to provide funding for the costs of the Project either through the issuance of (a) general obligation bonds of the City pursuant to the City Bond Act in a total aggregate principal amount not to exceed Three Million Dollars ($3,000,000) (the "Bonds"), (b) a general obligation bond of the City to be sold to the Bank in a total aggregate principal amount not to exceed Three Million Dollars ($3,000,000) (the "City Bond"), or (c) by entering into a loan with the Bank to borrow money from the Bank in a total principal amount not to exceed Three Million Dollars ($3,000,000) (the "Loan"); and
WHEREAS, as of October 1, 2011, the assessed value of all taxable property within the City, according to the last completed assessment for taxation, was Forty-Eight Million Eight Hundred Fifty-Nine Thousand Three Hundred Ninety-Three Dollars ($48,859,393), and the City had outstanding bonded and floating indebtedness as subject to the fifteen percent (15%) debt limit prescribed by Section 21-33-303 of the City Bond Act, as amended, in the amount of Three Million Four Hundred Ninety Thousand Dollars ($3,490,000), and outstanding bonded and floating indebtedness as subject to the twenty percent (20%) debt limit prescribed by Section 21-33-303 of the City Bond Act, in the amount of Three Million Four Hundred Ninety Thousand Dollars ($3,490,000); and
WHEREAS, the Bonds, the City Bond or the Loan, when added to the outstanding bonded indebtedness of the City, will not result in bonded indebtedness, exclusive of indebtedness not subject to the aforesaid fifteen percent (15%) debt limit, of more than fifteen percent (15%) of the assessed value of all taxable property within the City, will not result in indebtedness, both bonded and floating, exclusive of indebtedness not subject to the aforesaid twenty percent (20%) debt limit prescribed by Section 21-33-303 of the City Bond Act, in excess of twenty percent (20%) of the assessed value of all taxable property within the City, and will not exceed any constitutional or statutory limitation upon indebtedness which may be incurred by the City; and
WHEREAS, there has been no increase in said bonded and floating general obligation indebtedness of the City since October 1, 2011; and
WHEREAS, it would be in the best interest of the City for the Governing Body to provide funding for the costs of the Project by borrowing money through the issuance of the Bonds or the City Bond or by entering into the Loan; and
WHEREAS, the City reasonably expects that it will incur expenditures in connection with the Project for which the City intends to reimburse itself with the proceeds of the Bonds, the City Bond or the Loan; and
WHEREAS, the Governing Body is authorized and empowered by the City Bond Act and/or the Bank Act to issue the Bonds or the City Bond or to enter into the Loan for the purposes herein set forth and there are no other available funds on hand or available from regular sources of income for such purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY, ACTING FOR AND ON BEHALF OF THE CITY, AS FOLLOWS:
The Governing Body, acting for and on behalf of the City, hereby declares its intention to either (a) issue and sell the Bonds pursuant to the City Bond Act in an aggregate principal amount not to exceed Three Million Dollars ($3,000,000), (b) issue and sell the City Bond to the Bank pursuant to the City Bond Act and the Bank Act in an aggregate principal amount not to exceed Three Million Dollars ($3,000,000), or (c) enter into the Loan with the Bank pursuant to the City Bond Act and the Bank Act to borrow money from the Bank in a principal amount not to exceed Three Million Dollars ($3,000,000).
The Bonds, the City Bond or the Loan will be issued for the purpose of financing the Project, as authorized by the City Bond Act and the Bank Act.
The Bonds or the City Bond may be issued in one or more series and, if issued, will be general obligations of the City payable as to principal and interest out of and secured by an irrevocable pledge of the avails of a direct and continuing tax to be levied annually without limitation as to time, rate or amount upon all the taxable property within the geographical limits of the City.  The Loan will be payable from available revenues of the City and will not constitute an indebtedness of the City within the meaning of any constitutional or statutory restrictions, limitations, or provisions, and the taxing power of the City will not be pledged to the payment of the Loan.
The Governing Body proposes to direct the issuance of all or any portion of the Bonds or the City Bond or to authorize the Loan in the amount and for the purposes and secured as aforesaid at a meeting of the Governing Body to be held at its usual meeting place in the Police Department located at 305 Mike Espy Drive, Yazoo City, Mississippi, at the hour of 2:00 o'clock p.m. on November 14, 2011, or at some meeting or meetings subsequent thereto; provided, however, that if ten percent (10%) or Fifteen Hundred (1500), whichever is less, of the qualified electors of the City shall file a written protest with the City Clerk against the issuance of the Bonds or the City Bond or the authorization of the Loan on or before the aforesaid date and hour, then the Bonds or the City Bond shall not be issued or the Loan shall not be entered into unless approved at an election on the question thereof called and held as is provided by law; provided, further that if no protest is filed, then the Bonds or the City Bond may be issued and sold in one or more series or the City may enter into the Loan without an election on the question of the issuance thereof at any time within a period of two (2) years after November 14, 2011.
In full compliance with the City Bond Act, the City Clerk is hereby directed to publish a copy of this resolution once a week for at least three (3) consecutive weeks in The Yazoo Herald, a newspaper published in and having a general circulation in the City and qualified under the provisions of Section 13‑3‑31, Mississippi Code of 1972, as amended, with the first publication being not less than twenty-one (21) days prior to the date set forth in Section 4 of this resolution, and the last publication being made not more than seven (7) days prior to such date.
The City Clerk is hereby directed to procure from the publisher of the aforesaid newspaper the customary proof of the publication of this resolution and the required notice and have the same before the Governing Body on the date and hour specified in Section 4 hereof.
The City hereby declares its official intent to reimburse itself from the proceeds of the Bonds, the City Bond or the Loan for expenses incurred with respect to the Project subsequent to the date of this resolution.  This resolution is intended as a declaration of official intent under Treasury Regulation 1.150-2.  The Bonds, the City Bond or the Loan will not exceed the aggregate principal amount of Three Million Dollars ($3,000,000).
If any one or more of the provisions of this resolution shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any of the other provisions of this resolution, but this resolution shall be construed and enforced as if such illegal or invalid provision or provisions had not been contained herein.

REQUEST FOR BIDS
The Yazoo County Board of Supervisors are assisting Four homeowners accept sealed bids for the demolition of their existing unit and the contruction of the new replacement unit on the same lot. The bids are requested through the Mississippi Development Authority’s HOME grant program and all bidders are required to have a "Residential Builders License" and Proof of Insurance submitted to the County along with the completed Contractor’s Qualification and References Form prior to bidding. The form is available from the County or the Grant Adminstrator (Coker Consultants 662-627-2215)
The bid should be turn-key demolition, proper disposal, site preparation, 6 sets of plans and the construction of the new unit according to the plans and specifications. The project includes one (1) 3-Bedroom Unit "Montague" Plan, (2) 3-Bedroom Units "Winchester" Plan and (1) 3-Bedroom/2 Bathroom "Manufactured Unit", 16'x76' to replace an existing manufactured unit. The plans and specifications for all four (4) units along with the bid packets can be picked up or reviewed at the Yazoo County Board of Supervisors office or from the Grant Administrators office (662-627-2215). The Montague and Winchester plans are available to purchase ($8.00) from Jackson Blueprint (601-353-5803) and include all the specific MDA specifications.
A mandatory pre-bid conference will be held at the Yazoo County Supervisors Board Room on Tuesday November 8 at 2:00 P.M. Only the contractors attending this Pre-Bid Conference will be eligible to submit bids on Tuesday November 29, 2011 at 11:00 A.M. SALE OF USED EQUIPMENT AT PUBLIC AUCTION

The Mississippi Transportation Commission (Commission) will sell, by public auction, its surplus equipment as outlined below.
This will be a combined auction of equipment from District Three, Yazoo City, MS and District Five, Newton, MS.
Location and time of the sale:
Mississippi Department of Transportation, District Five Headquarters 7759 Highway 80 West, Newton, MS Wednesday, November 9,2011, 10:00 A.M.
All prospective bidders must register and receive a Bidder’s Number prior to the sale. Registration will begin at 8:00 A.M., Wednesday, November 9,2011, with the sale beginning at 10:00 A.M. The equipment may be inspected (week days only) from 8:00 A.M. to 3:00 P.M., Wednesday, October 26, 2011, through the day before the sale and 7:00 A.M. to 9:30 A.M. day of sale.
All registered bidders must have a Federal Tax Identification Number if registering as a business or governmental entity, or a Social Security Number if registering as an individual. Bidders registering for cities or counties must have a purchase order and letter of authorization.
Mississippi Code Section 25-4-105(3)(b) prohibits a public servant from being a purchaser, direct or indirect, at any sale made by the governmental entity of which he/she is an officer or employee. Accordingly, employees of the Mississippi Department of Transportation or the State of Mississippi, their spouses and dependent children are prohibited from being a purchaser at this auction.
All bids must be based on taking this used equipment “AS IS” and “WHERE IS”, paying for same with cash, cashier’s check, or money order before removal of said property on the day of the sale. Personal checks, company checks, or bank letters of credit will NOT be accepted. Payment must be made within five (5) working days after the day of the sale. After the day of the sale, cashier’s check or money order only will be accepted. Cash will not be accepted after the day of the sale.
Successful bidders will have until 4:00 P.M., Wednesday, November 23, 2011, to complete all transactions and remove equipment. Any equipment remaining after this time will be declared a “NO SALE”. Bidders who refuse to accept awards will be suspended from all equipment sales for a one-year period.
There is a processing fee for replacement titles. The fee is $25.00 plus the fee charged by the State Tax Commission as set forth in Section 63 -21-63 (2), Miss. Code Ann. (1972), as amended.
The Commission reserves the right to add or remove items of equipment from the sale list prior to the sale. The Commission also reserves the right to reject any or all bids.
All sales will be FINAL.

WHEREAS, the Governing Body, acting for and on behalf of the City, is also authorized under the City Bond Act and Sections 31-25-1 et seq., Mississippi Code of 1972, as amended (the "Bank Act"), and other applicable laws of the State of Mississippi (the "State"), to (a) issue a general obligation bond of the City to be sold to the Mississippi Development Bank (the "Bank") to finance the costs of the Project, or (b) enter into a loan with the Bank to borrow money to finance the costs of the Project; and

WHEREAS, the Project is in accordance with and in furtherance of the provisions of the City Bond Act and the Bank Act; and
WHEREAS, the Governing Body is authorized pursuant to the City Bond Act and/or the Bank Act to provide funding for the costs of the Project either through the issuance of (a) general obligation bonds of the City pursuant to the City Bond Act in a total aggregate principal amount not to exceed Three Million Dollars ($3,000,000) (the "Bonds"), (b) a general obligation bond of the City to be sold to the Bank in a total aggregate principal amount not to exceed Three Million Dollars ($3,000,000) (the "City Bond"), or (c) by entering into a loan with the Bank to borrow money from the Bank in a total principal amount not to exceed Three Million Dollars ($3,000,000) (the "Loan"); and
WHEREAS, as of October 1, 2011, the assessed value of all taxable property within the City, according to the last completed assessment for taxation, was Forty-Eight Million Eight Hundred Fifty-Nine Thousand Three Hundred Ninety-Three Dollars ($48,859,393), and the City had outstanding bonded and floating indebtedness as subject to the fifteen percent (15%) debt limit prescribed by Section 21-33-303 of the City Bond Act, as amended, in the amount of Three Million Four Hundred Ninety Thousand Dollars ($3,490,000), and outstanding bonded and floating indebtedness as subject to the twenty percent (20%) debt limit prescribed by Section 21-33-303 of the City Bond Act, in the amount of Three Million Four Hundred Ninety Thousand Dollars ($3,490,000); and
WHEREAS, the Bonds, the City Bond or the Loan, when added to the outstanding bonded indebtedness of the City, will not result in bonded indebtedness, exclusive of indebtedness not subject to the aforesaid fifteen percent (15%) debt limit, of more than fifteen percent (15%) of the assessed value of all taxable property within the City, will not result in indebtedness, both bonded and floating, exclusive of indebtedness not subject to the aforesaid twenty percent (20%) debt limit prescribed by Section 21-33-303 of the City Bond Act, in excess of twenty percent (20%) of the assessed value of all taxable property within the City, and will not exceed any constitutional or statutory limitation upon indebtedness which may be incurred by the City; and
WHEREAS, there has been no increase in said bonded and floating general obligation indebtedness of the City since October 1, 2011; and
WHEREAS, it would be in the best interest of the City for the Governing Body to provide funding for the costs of the Project by borrowing money through the issuance of the Bonds or the City Bond or by entering into the Loan; and
WHEREAS, the City reasonably expects that it will incur expenditures in connection with the Project for which the City intends to reimburse itself with the proceeds of the Bonds, the City Bond or the Loan; and
WHEREAS, the Governing Body is authorized and empowered by the City Bond Act and/or the Bank Act to issue the Bonds or the City Bond or to enter into the Loan for the purposes herein set forth and there are no other available funds on hand or available from regular sources of income for such purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY, ACTING FOR AND ON BEHALF OF THE CITY, AS FOLLOWS:
The Governing Body, acting for and on behalf of the City, hereby declares its intention to either (a) issue and sell the Bonds pursuant to the City Bond Act in an aggregate principal amount not to exceed Three Million Dollars ($3,000,000), (b) issue and sell the City Bond to the Bank pursuant to the City Bond Act and the Bank Act in an aggregate principal amount not to exceed Three Million Dollars ($3,000,000), or (c) enter into the Loan with the Bank pursuant to the City Bond Act and the Bank Act to borrow money from the Bank in a principal amount not to exceed Three Million Dollars ($3,000,000).
The Bonds, the City Bond or the Loan will be issued for the purpose of financing the Project, as authorized by the City Bond Act and the Bank Act.
The Bonds or the City Bond may be issued in one or more series and, if issued, will be general obligations of the City payable as to principal and interest out of and secured by an irrevocable pledge of the avails of a direct and continuing tax to be levied annually without limitation as to time, rate or amount upon all the taxable property within the geographical limits of the City.  The Loan will be payable from available revenues of the City and will not constitute an indebtedness of the City within the meaning of any constitutional or statutory restrictions, limitations, or provisions, and the taxing power of the City will not be pledged to the payment of the Loan.
The Governing Body proposes to direct the issuance of all or any portion of the Bonds or the City Bond or to authorize the Loan in the amount and for the purposes and secured as aforesaid at a meeting of the Governing Body to be held at its usual meeting place in the Police Department located at 305 Mike Espy Drive, Yazoo City, Mississippi, at the hour of 2:00 o'clock p.m. on November 14, 2011, or at some meeting or meetings subsequent thereto; provided, however, that if ten percent (10%) or Fifteen Hundred (1500), whichever is less, of the qualified electors of the City shall file a written protest with the City Clerk against the issuance of the Bonds or the City Bond or the authorization of the Loan on or before the aforesaid date and hour, then the Bonds or the City Bond shall not be issued or the Loan shall not be entered into unless approved at an election on the question thereof called and held as is provided by law; provided, further that if no protest is filed, then the Bonds or the City Bond may be issued and sold in one or more series or the City may enter into the Loan without an election on the question of the issuance thereof at any time within a period of two (2) years after November 14, 2011.
In full compliance with the City Bond Act, the City Clerk is hereby directed to publish a copy of this resolution once a week for at least three (3) consecutive weeks in The Yazoo Herald, a newspaper published in and having a general circulation in the City and qualified under the provisions of Section 13‑3‑31, Mississippi Code of 1972, as amended, with the first publication being not less than twenty-one (21) days prior to the date set forth in Section 4 of this resolution, and the last publication being made not more than seven (7) days prior to such date.
The City Clerk is hereby directed to procure from the publisher of the aforesaid newspaper the customary proof of the publication of this resolution and the required notice and have the same before the Governing Body on the date and hour specified in Section 4 hereof.
The City hereby declares its official intent to reimburse itself from the proceeds of the Bonds, the City Bond or the Loan for expenses incurred with respect to the Project subsequent to the date of this resolution.  This resolution is intended as a declaration of official intent under Treasury Regulation 1.150-2.  The Bonds, the City Bond or the Loan will not exceed the aggregate principal amount of Three Million Dollars ($3,000,000).
If any one or more of the provisions of this resolution shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any of the other provisions of this resolution, but this resolution shall be construed and enforced as if such illegal or invalid provision or provisions had not been contained herein.
