Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees, guests or invitees, in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to protect Lessor from any and all damages or claims arising out of Lessees acts in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to waive informalities.

The election of pork producer delegate candidates for the 2013 National Pork Producers (Pork Act) Delegate Body will take place at 1:30 pm, Friday, June 29, 2012 in conjunction with a Board of Directors meeting of Mississippi Pork Producers Association in Room 4044 of the Animal Dairy Sciences Department, Wise Center (MSU Vet School) at Mississippi State University in Starkville, MS. NOTICE OF PROPOSED AD
VALOREM TAX EFFORT
YAZOO COUNTY SCHOOL
DISTRCT
The Yazoo County School District will hold a public hearing on its proposed school district budget for fiscal 2013 on June 26, 2012 at 6:00 p.m. at the Courthouse Annex in the Boardroom of the Yazoo County Board of Supervisors office. At this meeting, a proposed ad valorem tax effort will be considered.
The Yazoo County School District is now operating with a projected total budget revenue of $17,146,585.38. Of that amount, 29 percent or $4,951,829.00 of such revenue is obtained through ad valorem taxes. For next fiscal year, the proposed budget has total projected revenue of $17,054,916.98. Of that amount, 29 percent or $5,008,354.00 is proposed to be financed through a total ad valorem tax levy.
For the next fiscal year, the proposed increase in ad valorem tax effort by the Yazoo County School District may result in an increase in the ad valorem tax millage rate. Ad valorem taxes are paid on homes, automobiles tags, business fixtures and equipment, and rental real property.
Any citizen of the Yazoo County School District is invited to attend this public hearing on the proposed ad valorem tax effort, and will be allowed to speak for a reasonable amount of time and offer tangible evidence before any vote is taken.
The school board of the school district, after the hearing has been held in accordance with the above procedures, may adopt an order requesting the levying of an ad valorem tax effort in dollars in excess of the certified tax rate. If such order is not adopted on the day of the public hearing, the scheduled date, time and place for consideration and adoption of the order shall be announced at the public hearing.
All hearings shall be open to the public. The school board of the school district shall permit all interested parties desiring to be heard an opportunity to present oral testimony within reasonable time limits and offer tangible evidence.
Each school board of a school district shall notify the taxing entity of the date, time and place of its public hearing. No school board of a school district my schedule its hearing at the same time as another overlapping school district in the same county.

ORDINANCE OF THE CITY OF YAZOO CITY, MISSISSIPPI
VENDORS;  AND  REPEALING
SECTION 14-30, OF THE CODE OF ORDINANCES OF THE CITY OF YAZOO CITY, MISSISSIPPI
RELATED THERETO.

WHEREAS, Section 21-19-35 of the Mississippi Code of 1972 provides that the governing authorities of municipalities shall have the power to adopt reasonable ordinances for the regulation of transient vendors not inconsistent with the provisions of Section 75-85-1 through 75-85-19 of the Mississippi Code; and
WHEREAS,  Section 21-19-35 of the Mississippi Code provides that authorities do not have the power to declare residential solicitations by transient vendors who are citizens of the State of Mississippi, or who are agents of corporations domiciled in the State of Mississippi, or who are agents of foreign corporations qualified to do business in the State of Mississippi to be a public nuisance or a misdemeanor unless said transient vendors are not in compliance with Sections 75-85-1 through 75-85-19 or local regulations; and
WHEREAS,  the governing authorities for the city of Yazoo City, Mississippi have previously adopted ordinances regulating transient vendors; and
WHEREAS, the governing authorities for the city of Yazoo City have determined that the best interests of the City of Yazoo would be served by repealing Section 14-30 of the City of Yazoo City Code of Ordinances and adopting reasonable ordinances consistent with the provisions of the Mississippi Code;
NOW THEREFORE BE IT ORDAINED by the Board of Mayor and Aldermen in council convened that the Code of Ordinances of the city of Yazoo City, Mississippi is hereby amended to regulate transient vendors, as follows:
Section 1. Definitions.
(a) Transient vendor means any person who transacts brief, temporary, or transitory business in this state either in one locality or by traveling from place to place in this state.  The term includes a vendor who for the purposes of carrying on such business hires, leases, uses, or occupies any building, structure, motor vehicle, railroad car or real property.
(b) Transient business means any commerce or trade activity conducted for the sale of merchandise or services that is carried on at a particular location for a period of less than six (6) months in each year, even though the owner of such business may conduct the business at another location for more than six (6) months in each year.
(c ) Person means an individual, corporation, association, partnership, or other entity.
(d) Municipal tax collector means the City Clerk of the city of Yazoo City, Mississippi.
Section 2.  Application of ordinance.
The provisions of these ordinances governing transient vendors shall not apply to:
(a) Civic and nonprofit organizations or wholesale sales to retail merchants by commercial travelers;
(b) Wholesale trade shows or conventions;
(c) Sales of goods, wares, services or merchandise by sample, catalogue or brochure for future delivery;
(d) Fairs and convention center activities conducted primarily for amusement or entertainment;
(e) Any general sale, fair, circus, auction, or bazaar sponsored by a church or religious group;
(f) Garage sales held on premises devoted to residential use;
(g) Sales or repairs of crafts or sales or repairs of items made by hand by the person making the crafts or items;
(h) Duly licensed flea markets operating from a fixed location;
(i) Sales of agricultural, dairy, poultry, seafood, or forest management products or services related to forest management or silvicultural activities, nursery products, foliage plants or ornamental trees, except such products or services sold at retail and not grown or produced within Mississippi;
(j) Sales of agricultural services.
A transient vendor not otherwise exempted from this chapter is not exempted from this chapter because of a temporary association with a local dealer, auctioneer, trader, contractor, or merchant, or by conducting the brief, temporary, or transitory business in the name of a local dealer, auctioneer, trader, contractor, or merchant.
Section 3.  Prohibition.
It shall be unlawful for any person to conduct or engage in transient business in the city of Yazoo City, Mississippi unless the person or owner of the merchandise or provider of the services which are being offered has secured a license.
Section 4.  Application for License.
A person desiring to conduct or engage in transient business in the city of Yazoo City must file a complete application and obtain a license to do so from the city of Yazoo City pursuant to the provisions of Sections 75-85-7 et seq. of the Mississippi Code of 1972, as amended.
Section 5.  License fee and bond requirements.
(1)Any person desiring to conduct or engage in transient business in the city of Yazoo City must pay a licensee fee in the amount of $250.00 to the municipal tax collector when the application is filed.
(2) In addition, to the license fee, the person or applicant must also execute a cash bond or tender a surety bond by a corporate surety authorized to do business in Mississippi in the amount of two thousand dollars ($2,000.00) or five percent (5%) of the wholesale value of the merchandise or service offered for sale by the person or applicant, whichever is less.  The surety bond shall be issued in favor of the state and shall be conditioned upon payment of (a) all taxes due from the applicant to the state or to the city of Yazoo City, Mississippi (b) any fines assessed against the applicant or the applicant’s agents or employees for a violation of this chapter; and (c) any judgment rendered against the applicant or the applicant’s agents or employees in a cause of action commenced by a purchaser of merchandise or services not later than one (1) year after the date of the sale of the merchandise or services.
(3) The bond tendered by a transient vendor must be maintained during the period that business is conducted in the city of Yazoo City and for a period of one (1) year after the termination of the business.  The bond shall be released only after the transient vendor has presented to the municipal tax collector satisfactory proof that all claims of purchasers of merchandise or services have been satisfied and sales taxes and other applicable taxes have been paid.
(4) Each applicant shall designate a resident of the county or city its registered agent.  The registered agent must agree in writing to act as the agent.  The applicant shall provide a copy of the agreement with the application for a license.
Section 6.  Issuance of license, validity of license, renewal.
(1)A license shall be issued only if the person applying for the license has satisfied the requirements for obtaining a license, and the license issued shall not be transferred.  The license when issued shall authorize the conducting of transient business only within the municipal boundaries of the city of Yazoo City and shall expire ninety (90) days after its issuance.
(2) A person may apply for renewal of the transient vendor license at anytime prior to the expiration of the initial license and paying a renewal license fee of twenty-five dollars ($25.00).  The renewal period shall not exceed ninety (90) days, and a license may be renewed only once.  After the renewal period expires, the person must apply anew for a license.
Section 7.  Penalty for violating.
Any person who knowingly or intentionally engages in transient business without having obtained a license or who knowingly or intentionally advertises, offers for sale or sells merchandise or services in violation of Section 3, of this ordinance shall be guilty of a misdemeanor and upon conviction shall be fined not more than five hundred ($500.00) or imprisoned in jail for not more than six (6) months or may be subject to both fine and imprisonment.  In addition, to the penalties described, the municipal tax collector shall be authorized to seize and sell any property of the person liable for the tax and penalty in the same manner as property is sold for delinquent ad valorem personal property taxes.
Section 8.  Miscellaneous.
(1)All licensed vendors engaged in transient business shall post in a prominent place, which can be clearly be seen by purchasers of merchandise or services being offered documentation showing the following: (a) the vendor’s state sales tax number; (b) transient vendor’s license number and (c) a statement indicating that he is required to give purchasers at the time of payment a receipt for purchases that includes the sales tax.  All documents posted shall be in bold type with legible letters and numbers of at least one (1) inch in height.
(2) All licensed vendors engaged in transient business shall keep accurate records and totals of all sales and the taxes collected and paid.  
Section 9. Repealer.
That Section 14-30, of the Code of Ordinances of the City of Yazoo City, Mississippi is hereby repealed.
Section 10.   Effective Date.
This Ordinance shall be in full force an effect thirty (30) days after passage and publication of same.
