PUBLIC HEARING NOTICE
Central Yazoo Water Association in Yazoo County, MS intends to make certain improvements to the rural water system. The proposed project will include improvements to the water supply system, water distribution system, and water storage facilities. The total estimated cost of the complete project is about $1.5 million.
Funding for this project will be provided in whole or in part from the State Revolving Fund (SRF) Water Program, also known as the Drinking Water Systems Improvements Revolving Loan Fund (DWSIRLF), which is administered by the MS Department of Health.
Information on the proposed project including maps showing the locations of the proposed improvements and tables providing cost estimates for the various elements of the proposed project are provided in a planning document referred to as the “SRF Drinking Water Facilities Plan” (Plan), which is on file at the offices of Central Yazoo Water Association. Persons wishing to examine the Plan and/or comment on the proposed project may contact Central Yazoo Water Association at 662/746-7531. Written comments can also be submitted by mail to Central Yazoo Water Association, Post Office Box 116, Yazoo City, MS, 39194.
Comments will be received for a period of 30 days from the date of publication of this notice, after which the written comment period will end. Persons wishing to make public comments on the proposed project are invited to attend the public hearing that is to be held at the offices of Central Yazoo Water Association at 6:00 pm local time, Monday, April 24, 2012.
The Plan will incorporate and address any and all comments received from the public up through the time of the Public Hearing, and the Plan will be submitted to the MS Department of Health for review and approval once it has been finalized.

ORDINANCE AMENDING
SECTION 22-41 OF THE CITY OF YAZOO CITY, MISSISSIPPI CODE OF ORDINANCES
REGARDING UNIFORM
RESIDENTIAL GARBAGE
COLLECTION, APPROVED
CONTAINERS, PLACEMENT OF CONTAINERS FOR COLLECTION AND UNIFORM FEES FOR
COLLECTION; TO PROVIDE FOR AN EXEMPTION FOR DISABLED VETERANS
WHEREAS, the City of Yazoo is a special charter municipality organized and existing pursuant to the laws of the State of Mississippi; and
WHEREAS, Section 21-19-2(2)(d) of the Mississippi Code of 1972, as amended provides that the governing authority of a municipality may adopt an ordinance authorizing the granting of exemptions from the fees or charges for certain generators of garbage and/or rubbish; and
WHEREAS, the City of Yazoo has not adopted an ordinance authorizing the granting of exemptions from fees or charges for certain generators of garbage and/or rubbish; and
WHEREAS, Section 22-41(c) of the Yazoo City of Code of Ordinances provides for the collection of a uniform fee of $21.00 per month per residence defined as a single family dwelling unit; and
WHEREAS, Section 22-41(d) authorizes the Yazoo Public Service Commission to collect the garbage fee as a utility charge and assess same in its residential bills; and
WHEREAS, the Yazoo Public Service Commission has not been authorized to grant exemptions concerning the uniform garbage collection fee; and
WHEREAS, the governing authorities believe that the best interests of the City of Yazoo City Mississippi would be served by granting an exemption for certain generators of garbage and/or rubbish;
NOW THEREFORE BE IT ORDAINED by the Board of Mayor and Aldermen of the City Yazoo City, Mississippi in council convened as follows:
Section 1. That Section 22-41(c) of the Code of Ordinances for the City of Yazoo City shall be amended to read as follows:
(c) A uniform fee for residential garbage collection in the amount of $21.00 per month shall be assessed and collected from each residence unless the residence has been granted an exemption from the payment of the fee as provided herein.
(1) A residence is hereby defined as a single family dwelling unit but does not include single family dwelling units in which only the minimum electric rate set forth in Section 22-32 of the Code of Ordinances is billed during the month.
(2) The uniform garbage fee may be waived for the residence of a 100% physically or mentally impaired or disabled veteran of the United States armed forces having received an honorable discharge from service, if the impaired or disabled veteran’s residence generates nominal garbage. A veteran’s residence shall be deemed to generate nominal garbage if it places for collection only one (1) City approved garbage container during collections. The City’s sanitation department shall track and record the number of garbage collection containers placed by a residence that has been granted a waiver during its collections.
In order to receive a waiver or exemption of the fee, the disabled or impaired veteran must file with the City Clerk an application each year. The following must be submitted with the application: (1) residence ownership or lease documentation such as a deed, homestead exemption notice, or lease; and (2) DD 214 showing honorable discharge from military service; and (3) physician’s statement or documentation from the military verifying 100% physical or mental impairment or disability rating; and (4) a statement from the City’s sanitation department verifying that the residence generates nominal garbage. The statement from the City’s sanitation department shall not be required upon initial application of the disabled veteran for the waiver; and (5) a copy of a utility statement showing utilities are in the veteran's name. The City Clerk shall approve or deny requests for waiver or exemption from the fee in writing and shall provide written notice to the Yazoo Public Service Commission of any exemptions. Exemptions or waivers shall be effective forty five (45) days following the granting of same for one (1) year.
A disabled veteran who applies for waiver or exemption from the garbage fee and is denied same may appeal the denial to the governing authorities of Yazoo City by submitting a written request for a hearing to the City Clerk within fourteen (14) days of receipt of the Clerk’s written denial.
Section 2. That Section 22-41(d) of the Code of Ordinances for Yazoo City shall be amended to read as follows:
(d) The uniform residential garbage collection fee shall be collected by the Public Service Commission of Yazoo City. The Public Service Commission of Yazoo City shall collect the uniform residential garbage collection fee by assessing same when it bills users of the City’s utilities in accordance with Section 22-35 of this Code. The fee shall be assessed unless a waiver or exemption has been authorized by the City in accordance with Section 22-41(c). Any person failing to pay the residential garbage collection fee when due shall be subject to action by the Public Service Commission. The action taken by the Public Service Commission for failing to pay the garbage collection fee shall be the same as the action taken for failing to timely pay utility charges.
Section 3.
All other provisions of Section 22-41 shall remain in full force and effect.
Section 4. Effective Date.
This ordinance shall become effective thirty (30) days from and after passage and publication.

The Owner reserves the right to reject any and all bids, to waive any and all informalities, to hold all bids for examination for a period not to exceed thirty (30) days and to award the contract based on the best bid within said sixty (60) day period. All bids shall be in compliance with and subject to sections 31-3-15 and 31-3-21 of the Mississippi Code of 1972 as annotated and amended, and in all case law pertaining thereto.
