WHEREAS, on April 10, 2007 STELLA LEWIS and husband, J. D. LEWIS executed a Deed of Trust to E. Barry Bridgforth, Trustee for C. JOHN CARTWRIGHT, III, which said deed of trust is recorded in Book 348B at Page 653 of the Records of Yazoo County, Mississippi, and
WHEREAS, Default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, C. JOHN CARTWRIGHT, III, the legal holder of said indebtedness, having requested the undersigned Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder together with attorney's fees, trustee's fees and expense of sale;
NOW, THEREFORE, I, E. Barry Bridgforth, Trustee in said deed of trust, will on October 25, 2011 offer for sale at public outcry and sell, commencing at 11:00 A. M. and continuing within legal hours, between 11:00 o'clock a. m. and 4:00 o'clock p. m., at the South door of the Yazoo County Courthouse in Yazoo City, Mississippi, to the highest and best bidder, for cash, the following described property situated in Yazoo County, Mississippi, to-wit:
Lot 6 of the J. F. Liddon Subdivision of Lot 325 of the  Lintonia Addition to Yazoo City, Yazoo County, Mississippi, according to map of said subdivision drawn by J. B. Williams, Civil Engineer, on May 3, 1946, and of record in Plat Book 5 at Page 12 of the records of the Chancery Clerk’s office of Yazoo County, Mississippi.
LESS AND EXCEPT:
That part conveyed to the City of Yazoo City, Mississippi, by Deed recorded in Book 45A, Page 260 of the Records of Deeds of Yazoo County, Mississippi.

containing approximately 133.0 acres, currently leased to Shannon Greer.

That portion of Sixteenth Section, Township 11, Range 2 East, containing approximately 19.0 acres, currently leased to Day Place Farms, James A. Nichols.

That portion of Sixteenth Section, Township 12, Range 2 East, containing approximately 213.0 acres, currently leased to Marvin O’Reilly.

Farms, A Mississippi Partnership.
NOTE: By order of the Board of Education, advance payment of lease and     certification of  Insurability will be required on all leases, due upon execution of    Contract. (within fifteen days of awarding lease) 5% of bid amount will be made payable in the form of cashier’s check or money order at the time of bid.         (Refundable if bid not successful)  A security deposit in the amount of 1 year’s tax will be paid at the execution of the Contract.
The County Board of Education reserves the right to execute timber deeds; oil, gas and mineral leases; and deed for rights of way serving power, gas, tele  phone lines and public roads.    
All leases will be subject to the laws of  Mississippi  regarding the use of timber upon Sixteenth Section lands.
Lessees will be required to indemnify and hold harmless Lessor from any and all damages, claims or rights of action of any kind or nature whatsoever arising out of any acts of Lessees, their agents, servants, employees,  guests or invitees,  in the exercise of the rights granted in said lease.  Lessee will also be required to procure general liability insurance in an amount to be determined by Lessor which will name Lessor as an insured under said policy or policies to   protect Lessor from any and all damages or claims arising out of Lessees acts   in the exercise of the rights granted under said lease.
Bid forms shall be secured from the Office of the County Superintendent of    Education.  All bids are required to be submitted on such form.
Each bidder must satisfy the Board of Education as to his ability to comply with  the term of his bid.
The Board of Education reserves the right to reject any and all bids and to   waive informalities.
